Rider Terms of Use

These Terms and Conditions ("Agreement") constitute a legal agreement between ATULYASH FOODS PRIVATE LIMITED ("Atulyash," "Company," "We") and the independent contractor ("Delivery Partner," "You") who registers on the Atulyash Delivery App.

1. Nature of Relationship

  • Independent Contractor: You acknowledge that you are an independent service provider. This Agreement does not create an employer-employee relationship, partnership, or joint venture.
  • Flexibility: You have the absolute discretion to go "Online" or "Offline." However, once an order is accepted, you are contractually bound to complete the delivery as per Company standards.

2. Eligibility & Onboarding

  • Documentation: You must provide a valid Driving License, Aadhaar Card, PAN Card, and Vehicle Registration (RC). You represent that all documents provided are genuine.
  • Vehicle: You are responsible for providing your own vehicle, fuel, and maintenance. The vehicle must be in good working condition and insured under Indian law.

3. Real-Time Tracking & App Usage

  • Location Consent: You grant Atulyash permission to track your real-time location while the app is in the "Online" mode (including background tracking) to facilitate order assignment and customer tracking.
  • Device: You must maintain a working smartphone with an active data connection. Atulyash is not responsible for any data charges or device damage.

4. Code of Conduct & Service Standards

  • Timeliness: You shall make every effort to deliver orders within the estimated time provided.
  • Professionalism: You must behave politely with customers and kitchen staff. Any reports of harassment, theft, or intoxication will result in immediate permanent deactivation.
  • Safety: You must follow all traffic rules. Atulyash is not liable for any fines, accidents, or injuries incurred while performing deliveries.

5. Payments, Earnings & Atulyash Partner Wallet

  • Payouts: Earnings (base pay per delivery + distance incentives) will be calculated by the App and settled into your linked bank account on a [Weekly/Daily] basis.
  • Cash on Delivery (COD): If you collect cash from a customer, that amount must be deposited with the Company or balanced against your earnings via the Atulyash Partner Wallet. Failure to remit COD collections to the Company is considered a criminal breach of trust and will lead to legal action.
  • Deductions: The Company reserves the right to deduct amounts from your earnings for proven customer complaints, damaged goods due to mishandling, or unreturned COD cash.

6. Refunds & Re-deliveries

  • Mishandling: If a product is damaged due to your negligence (e.g., spilling food), the cost may be deducted from your partner wallet.
  • Wrong Delivery: If you deliver to the wrong address, you may be required to rectify the delivery at your own cost.

7. Confidentiality

You will have access to customer names, addresses, and phone numbers. You are strictly prohibited from:

  • Saving customer contact details for personal use.
  • Contacting customers after the delivery is completed.
  • Sharing customer data with any third party.

Violation of this clause will result in immediate termination and reporting to authorities under the DPDP Act.

8. Termination & Deactivation

  • By You: You may stop using the service at any time by deleting the app and settling any outstanding COD dues.
  • By Us: We may "Block" or "Deactivate" your account without notice for:
    • Low acceptance rates or high cancellation rates.
    • Fraudulent activity (e.g., "ghost" deliveries).
    • Violation of any terms in this Agreement.

9. Indemnity

You agree to indemnify and hold harmless ATULYASH FOODS PRIVATE LIMITED from any claims, losses, or damages (including legal fees) arising out of your negligence, traffic violations, or misconduct during the performance of services.

10. Governing Law & Dispute Resolution

This Agreement is governed by the laws of India. Any disputes shall be settled through arbitration in Panipat, Haryana.
